Terms of Use

The Service helps users locate and view information about sporting events and related video content while attempting to minimize exposure to game results and other spoilers.

The Service may display or provide schedules, team names, team colors, event information, links, embedded videos, thumbnails, titles, descriptions, and other content obtained from or made available by third parties.

The Service is provided for personal, informational, and entertainment purposes only.

The Service is an independent, unofficial, fan-created project built by fans for fans.

The Service is not affiliated with, associated with, authorized by, endorsed by, sponsored by, licensed by, or otherwise connected to the National Football League (“NFL”), Major League Baseball (“MLB”), the National Hockey League (“NHL”), the National Basketball Association (“NBA”), the Women’s National Basketball Association (“WNBA”), the National Collegiate Athletic Association (“NCAA”), the Fédération Internationale de Football Association (“FIFA”), the Premier League, Amaury Sport Organisation (“A.S.O.”), ESPN, or any other sports league, conference, governing body, federation, team, club, broadcaster, media company, athlete, event organizer, venue, sponsor, or related entity.

No league, organization, team, broadcaster, or other third party has approved, reviewed, sponsored, or endorsed the Service unless we expressly state otherwise in writing.

League names, team names, competition names, event names, colors, and other identifying references may be used solely to identify and describe the relevant leagues, teams, competitions, or events. All trademarks, service marks, trade names, logos, copyrights, and other intellectual property belonging to third parties remain the property of their respective owners.

Nothing displayed through the Service should be interpreted as suggesting a partnership, sponsorship, endorsement, agency relationship, joint venture, or other official relationship between us and any third party.

The Service may embed, link to, organize, index, or otherwise facilitate access to videos and other content hosted or provided by third parties, including video platforms, broadcasters, publishers, and sports-information providers.

We do not host or control third-party videos unless expressly stated otherwise. Third-party content is provided subject to the applicable third party’s own terms, policies, restrictions, and availability.

We do not guarantee that third-party content:

• is accurate, complete, properly labeled, authorized, lawful, suitable, or available;
• corresponds to the event with which it is displayed;
• will remain online or accessible;
• will play correctly in every location or on every device; or
• will be free of advertisements, spoilers, tracking technologies, or other material.

Your interactions with third-party websites, platforms, videos, advertisements, and services are solely between you and the applicable third party. We are not responsible for third-party content, conduct, privacy practices, terms, availability, or security.

Leaving the Service. When you follow a link away from the Service, you leave it, and we have no control over the content, conduct, or availability of the destination. Your use of that destination is governed by its terms and policies rather than these Terms. This includes spoilers: nothing we do can protect you once you have left, and a destination may display scores, outcomes, or other results directly.

Community discussion links. The Service may link to discussion threads about a game hosted on third-party community platforms, including Reddit. Those threads are written by members of the public, not by us. We do not host, control, moderate, review, endorse, or verify their contents, and we do not guarantee that a linked thread corresponds to the game it is displayed with, remains available, or is free of inaccurate, offensive, or unlawful material. Your use of any such platform is governed by that platform’s own terms and policies rather than these Terms. For more information, see Reddit’s Terms and Rules.

These destinations state the result. A discussion thread about a completed game exists in order to discuss how it ended. Unlike other links on the Service, following one is certain to reveal the outcome, and the outcome may also be visible in the link itself—in the address, in your browser’s status bar, or in a preview generated by another application—before you follow it. We place these links behind a warning for that reason. By proceeding past that warning you accept that the result will be revealed.

The inclusion of a link, embed, source attribution, or reference does not constitute our endorsement of that third party or its content.

Schedules, event times, team information, and related metadata may be obtained from third-party sources.

Although we attempt to present useful and current information, sporting-event schedules frequently change. We do not guarantee that any date, time, matchup, status, venue, broadcast information, or other event information is accurate, complete, or current.

You should verify important event information through an official source before relying on it.

Avoiding spoilers is the purpose of the Service, and every part of it is built with that in mind. We make a genuine and continuing effort to keep scores, outcomes, and other results off every surface we control.

Even so, we cannot promise that a spoiler will never reach you, and we do not. Much of what appears on the Service comes from third parties whose wording we neither write nor control—a video title, thumbnail, or description published by a league or broadcaster may reveal a result at any time and without warning, including after we have already displayed it.

Spoilers may appear through, among other things:

• video titles, thumbnails, descriptions, captions, advertisements, or recommendations;
• incorrect or mismatched videos;
• schedules, metadata, external links, or third-party interfaces;
• links to community discussion threads, which state the result by design;
• delayed, incomplete, or incorrectly categorized content;
• browser features, search results, notifications, or embedded players; and
• software errors or circumstances outside our control.

By using the Service, you acknowledge and accept the possibility that scores, outcomes, significant plays, or other spoilers may be revealed.

You may use the Service only for lawful, personal, and noncommercial purposes.

You may not:

• interfere with, disrupt, damage, or impair the Service;
• attempt to gain unauthorized access to the Service or its systems;
• introduce malware, malicious code, automated attacks, or excessive traffic;
• use automated means to scrape, copy, extract, or systematically collect content from the Service without our written permission;
• bypass technical restrictions or security measures;
• submit false, misleading, abusive, or automated content through any form on the Service;
• use any form on the Service to transmit malware, spam, or bulk unsolicited messages;
• use the Service to violate another person’s rights;
• misrepresent your relationship with us or with any league, team, broadcaster, or other organization; or
• use our original branding, software, design, or content in a manner that falsely suggests affiliation, endorsement, or authorization.

We may restrict or terminate access to the Service when we reasonably believe these Terms have been violated.

Except for third-party content, names, trademarks, data, and materials, the Service and its original software, interface, design, arrangement, text, graphics, branding, and other original elements are owned by us or our licensors and are protected by applicable intellectual-property laws.

These Terms grant you only a limited, revocable, nonexclusive, nontransferable right to access and use the Service for its intended personal purpose. No other rights are granted.

We respect the intellectual-property rights of others.

A copyright owner or authorized representative who believes that material accessible through the Service infringes their rights may contact us at hi[at]unspoiled[dot]xyz with:

• identification of the protected work;
• identification and location of the material at issue;
• the requesting party’s name and contact information;
• a statement explaining the basis of the claim; and
• sufficient information for us to evaluate and respond to the request.

We may remove links, embeds, references, or other material at our discretion while reviewing a request.

The Service provides a suggestions form through which you may send us a message. Use of that form is voluntary.

What you may submit. You may submit only information you have the right to share. You may not submit unlawful, infringing, threatening, harassing, deceptive, or malicious content, personal information about another person, confidential information, or content intended to disrupt or gain unauthorized access to the Service.

No confidentiality. Submissions are not confidential. We make no commitment to treat any submission as secret or proprietary, and no confidential or fiduciary relationship is created by sending one. Do not send information you do not want us to have.

License to act on submissions. By submitting a message, you grant us a worldwide, perpetual, irrevocable, nonexclusive, royalty-free, sublicensable, and transferable license to use, store, reproduce, adapt, and act on it for any purpose relating to operating, maintaining, and improving the Service, without compensation, credit, or attribution to you.

No obligation to reply or act. We are under no obligation to read, respond to, acknowledge, retain, or act on any submission, and no submission creates any entitlement to a feature, change, correction, or removal.

Submissions are not published. We do not publish submissions or display them to other users, and the Service does not offer public posting, comments, or other user-generated content.

Copyright and rights-holder requests should follow Section 8 rather than the suggestions form. How information from a submission is handled is described in our Privacy Policy.

We may add, remove, modify, suspend, restrict, or discontinue any portion of the Service at any time, with or without notice.

We do not guarantee that the Service or any feature, schedule, video, link, or other content will always be available, uninterrupted, secure, compatible, or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL MEET YOUR EXPECTATIONS;
• INFORMATION OR CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR PROPERLY CATEGORIZED;
• VIDEOS OR LINKS WILL BE CORRECT OR AVAILABLE;
• THE SERVICE WILL PREVENT SPOILERS;
• THE SERVICE WILL OPERATE WITHOUT INTERRUPTION OR ERROR; OR
• DEFECTS OR ERRORS WILL BE CORRECTED.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICE.

THIS INCLUDES DAMAGES ARISING FROM:

• ACCIDENTAL SPOILERS;
• INCORRECT, DELAYED, OR MISSING INFORMATION;
• INCORRECT OR UNAVAILABLE VIDEOS;
• THIRD-PARTY CONTENT OR SERVICES;
• LOSS OF DATA, OPPORTUNITY, PROFITS, GOODWILL, OR ENJOYMENT;
• SERVICE INTERRUPTIONS OR SECURITY INCIDENTS; OR
• YOUR RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US TO USE THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY US DOLLARS (US $50).

Because the Service is currently provided without charge, the monetary cap will generally be US $50.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

To the extent permitted by law, you agree to indemnify and hold harmless us and our owners, officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Service, your material violation of these Terms, or your infringement of another person’s rights.

We may update these Terms periodically to reflect changes to the Service, our practices, or applicable law.

The revised Terms will be posted through the Service with an updated Effective Date. Your continued use of the Service after revised Terms become effective constitutes acceptance of those revised Terms.

If you do not agree to an updated version, you must stop using the Service.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the Service must be brought in the state or federal courts located in New York County, New York, and you consent to the jurisdiction and venue of those courts.

Nothing in this section deprives a consumer of protections that cannot legally be waived under the law of the consumer’s jurisdiction.

If any provision of these Terms is held unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede prior communications concerning the Service.
